Welcome to Sun Spot Snapshots ("we," "us," or "our"), a premier photography and videography studio based in Palm Beach, Florida. By engaging our services, you ("Client" or "you") agree to be bound by the following Terms of Service ("Terms"). Please read these Terms carefully before booking or using our services.
1. Services Sun Spot Snapshots provides professional photography, videography, and drone coverage, specializing in weddings, real estate, and custom projects. Services include but are not limited to on-location shoots, editing, and delivery of high-resolution digital files. Specific services, deliverables, and timelines will be outlined in a separate Service Agreement or contract signed by both parties.
2. Booking and Payments

Reservation: A non-refundable deposit (typically 50% of the total fee) is required to secure your booking. The remaining balance is due 7 days prior to the event or shoot date.

Payment Methods: We accept payments via credit card, bank transfer, or other methods specified in the Service Agreement. Late payments may incur a 5% fee per week.

Cancellations: Cancellations made 30+ days before the event incur a 25% cancellation fee. Cancellations within 30 days forfeit the deposit. No refunds are issued for cancellations within 7 days of the event.

Rescheduling: Rescheduling requests are subject to availability and may incur a $250 fee if within 14 days of the event.
3. Client Responsibilities

Access and Permissions: Client must secure all necessary permits, permissions, and access to shoot locations, including private properties or restricted areas for drone operations.

Timeliness: Client agrees to adhere to the agreed-upon schedule. Delays caused by Client may reduce shoot time or incur additional fees at $200/hour.

Conduct: Client and their guests must respect our staff and equipment. We reserve the right to terminate services without refund if unsafe or abusive behavior occurs.
4. Drone Operations

Sun Spot Snapshots adheres to all Federal Aviation Administration (FAA) regulations for drone operations. Drone services are weather-dependent and subject to airspace restrictions. If drone use is prohibited due to legal or safety concerns, no refund will be issued, but alternative solutions will be offered.
5. Deliverables

Editing: We provide professionally edited photos and videos as specified in the Service Agreement. Raw or unedited files are not provided unless explicitly agreed upon.

Delivery: Digital files are delivered via a secure online gallery within 4-6 weeks for weddings or 2-3 weeks for real estate shoots, unless otherwise specified. Rush delivery may incur additional fees.

Storage: We retain files for 90 days post-delivery. After this period, file retrieval may incur a $100 fee, subject to availability.
6. Usage Rights and Licensing

Client License: Client receives a non-exclusive, perpetual license to use delivered photos and videos for personal or commercial purposes (e.g., real estate listings, personal keepsakes). Resale or transfer of this license is prohibited without our written consent.

Our Rights: Sun Spot Snapshots retains copyright and may use images/videos for promotional purposes (e.g., website, social media) unless Client requests otherwise in writing at booking.

Model Release: Client grants us permission to use images/videos featuring Client or their guests for marketing, unless a written opt-out is provided.
7. Creative Control Sun Spot Snapshots maintains artistic discretion over editing style, shot composition, and final deliverables, consistent with our luxurious brand aesthetic. Client may request specific shots, but final decisions rest with us to ensure quality.
8. Liability

Limitation of Liability: Our liability is limited to the amount paid for services. We are not liable for indirect damages, including emotional distress or lost opportunities.

Force Majeure: We are not liable for failure to perform due to unforeseen circumstances (e.g., weather, illness, equipment failure). In such cases, we will reschedule or issue a pro-rated refund at our discretion.

Equipment and Safety: We maintain professional-grade equipment, but Client assumes risk for damage to their property caused by standard operations, absent gross negligence.
9. Dispute Resolution

Mediation: Disputes will first be addressed through mediation in Palm Beach County, Florida. If unresolved, disputes will proceed to binding arbitration.
